The Better Off Overall Test (BOOT Test) is a Requirement to be FWO Compliant within Australia

The BOOT Test Problem

Over the past five years, legislation to protect workers from underpayment has been passed and is now being enforced, with either enforceable undertakings or prosecutions being applied to rectify the underpayments and punish the business, its management, and directors. https://www.fwc.gov.au/better-off-overall-test

In simple terms, the BOOT is applied at award modifications, EBA negotiations and across all employment categories, including salaried employees

“The Better Off Overall Test (BOOT) in Australia does not have a specific wage threshold; it applies to all employees covered by a proposed enterprise agreement, regardless of income. However, employees earning above the high-income threshold ($183,100 per annum as of 1 July 2025) may have a different agreement”

It is also used to validate that employees were not underpaid based on the times they would be paid at the appropriate award level.
